Merrill is a staunch advocate for privacy who had landmark challenges to the National Security Letter (NSL) provision of the USA Patriot Act in 2004. He denied an FBI request to provide electronic records including account numbers and billing information for customers of his ISP company Calyx Internet Access. He challenged the FBI and Department of Justice, but due to the lifelong gag order that accompanies the NSL, Merrill could not speak about the lawsuit publicly. In 2015 a judge ruled in his favor for the first ever lifting of a NSL-related gag order, allowing Merrill to finally address the contents of the NSL.
Covered by outlets including The New York Times, The Guardian and The Washington Post, Merrill’s defense of privacy led to a turning point against the USA Patriot Act and highlighted balancing between national security interests and civil liberties.
